Apex and SaleGuard Software Licenses
Bundled Perpetual License
A bundled perpetual license is granted in conjunction with an OpenEye server or appliance. A bundled Perpetual license has no expiration date and may be used for the life of OpenEye hardware on which it is installed.
- Support - Technical support shall be provided to authorized channel partners for 3 years from the date of initial hardware shipment. Technical support is available beyond 3 years for Apex software with a current OWS subscription or SaleGuard software with a current software maintenance agreement (SMA).
- Apex Upgrades - Users may upgrade to the latest version of Apex software free during the term of their OWS subscription as reflected on the associated commercial invoice.
- SaleGuard Upgrades - SaleGuard perpetual licenses include a 3-year software maintenance agreement. Users may upgrade to the latest version of SaleGuard software free during this SMA term. Software upgrades are available beyond 3-years subject to the continuous maintenance of a current SMA.
- OWS Access - Some Apex and SaleGuard functionality is dependent upon maintaining a current OWS subscription or SaleGuard software maintenance agreement. While a user may continue to utilize Apex and SaleGuard software, some functionality will be lost upon the expiration of the associated OWS Subscription or SaleGuard SMA.
Perpetual License
A perpetual license is granted to run OpenEye software on a third-party server or appliance. A perpetual license has no expiration date and is transferable between hardware devices during the term of the applicable OWS subscription or SaleGuard software maintenance agreement.
- Apex Support - Apex technical support shall be provided to authorized channel partners for 1 year from the date of initial activation. Apex technical support is available beyond 1 year for Apex software with a current OWS subscription.
- Apex Upgrades - Users may upgrade to the latest version of Apex software free during the term of their OWS subscription as reflected on the associated commercial invoice.
- SaleGuard Support - SaleGuard technical support shall be provided for 3 years from the date of initial activation. SaleGuard technical support is available beyond 3 years for SaleGuard software with a current software maintenance agreement.
- SaleGuard Upgrades - SaleGuard perpetual licenses include a 3-year software maintenance agreement. Users may upgrade to the latest version of SaleGuard software free during this SMA term. Software upgrades are available beyond 3-years subject to the continuous maintenance of a current SMA.
- OWS Access - Some Apex and SaleGuard functionality is dependent upon maintaining a current OWS subscription or SaleGuard software maintenance agreement. While a user may continue to utilize Apex and SaleGuard software, some functionality will be lost upon the expiration of the associated OWS Subscription or SaleGuard SMA.
Subscription License
A subscription license is provided to run OpenEye software on any server or appliance. A subscription license expires with the passage of time after which the software may no longer be used. Subscriptions licenses are valid for the duration specified on the associated commercial invoice beginning on the day the software is first activated. Once expired, the software will cease to function until such time the license is renewed.
- Support - Technical support shall be provided to authorized channel partners during the term of their subscription license.
- Upgrades - Users may upgrade to the latest version free during the term of their subscription license.
All three license types and OpenEye Software is subject to the OWS Terms of Use Agreement
